1. Acceptance of Terms

By accessing or using WitnessMark services (alpr.icu, waza.icu, yesand.icu), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Service Description

WitnessMark provides a QR-based location and time tracking system that allows users to:

• Create encrypted QR codes ("beacons") encoding device IDs, GPS coordinates, and timestamps
• Track when and where beacons are scanned
• Receive photos from others via QR code scanning (yesand.icu)

3. User Accounts

Access to certain features requires authentication via Cloudflare Access. You are responsible for maintaining the security of your account and for all activities that occur under your account.

4. Acceptable Use

You agree NOT to use WitnessMark to:

• Violate any applicable laws or regulations
• Track individuals without their knowledge or consent
• Harass, stalk, or threaten others
• Upload illegal, harmful, or offensive content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt our services

5. User Content

You retain ownership of content you create or upload (beacons, photos, etc.). By using our services, you grant us a license to store and transmit your content as necessary to provide the service.

6. Disclaimer of Warranties

WitnessMark is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, secure, or error-free.

7. Limitation of Liability

To the maximum extent permitted by law, WitnessMark and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the service
• Any unauthorized access to or use of our servers
• Any interruption or cessation of transmission to or from the service
• Any bugs, viruses, or other harmful code that may be transmitted through the service

8. Indemnification

You agree to indemnify and hold harmless WitnessMark and its operators from any claims, damages, losses, or expenses arising from your use of the service or violation of these terms.

9. Termination

We reserve the right to suspend or terminate your access to the service at any time, for any reason, without notice. Upon termination, your right to use the service will immediately cease.

10. Changes to Terms

We may modify these Terms of Service at any time. Continued use of the service after changes constitutes acceptance of the new terms.

11. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
